These Terms & Conditions govern all services provided by TutkuSaL Global Freight & Logistics (“TutkuSaL”, “we”, “our”, or “us”) to customers, exporters, importers, traders, and partners (“Client” or “Customer”). By requesting a quotation, booking a shipment, or using our services, the Client agrees to these terms.
1. Scope of Services
TutkuSaL provides international freight forwarding and logistics services, including but not limited to:

Air, sea, and land transportation

Container shipping (FCL, LCL)

Bulk, breakbulk, and project cargo
-
Livestock and specialized transport
-
Customs clearance and documentation
-
Warehousing, distribution, and supply chain coordination
-
Intermodal and multimodal logistics
-
Door-to-door and relocation services
TutkuSaL acts as a logistics intermediary and service coordinator unless otherwise stated in writing.
2. Quotations and Pricing
All quotations are:

Based on information provided by the Client
-
Subject to change due to market conditions, fuel surcharges, currency fluctuations, and carrier updates
-
Valid only for the specified period
-
Subject to revision if shipment details change
Additional costs may apply for:
-
Demurrage, detention, or storage
-
Port congestion or delays
-
Customs inspections or documentation
-
Special handling or regulatory requirements
3. Client Responsibilities
The Client must:

Provide accurate shipment details, including cargo type, weight, dimensions, and value
-
Ensure compliance with international shipping and safety regulations
-
Provide all required export and import documentation
-
Declare dangerous or restricted goods
-
Ensure proper packaging and labeling
-
Confirm insurance requirements
TutkuSaL shall not be responsible for delays, penalties, or losses caused by incorrect or incomplete information.
4. Packaging and Cargo Preparation
The Client is responsible for proper packing unless TutkuSaL is contracted to provide packing services. Cargo must be:

Securely packed and protected

Suitable for international transport
-
Compliant with carrier and regulatory standards
TutkuSaL may refuse unsafe or non-compliant cargo.
5. Dangerous and Restricted Goods
The Client must declare all hazardous, chemical, or dangerous cargo. Failure to disclose such information may result in:

Shipment cancellation

Regulatory penalties
-
Liability for damages or delays
-
TutkuSaL reserves the right to refuse or terminate transport of non-compliant cargo.
6. Transit Times and Delivery
Transit times are estimates and not guaranteed. TutkuSaL is not liable for delays caused by:

Weather conditions
-
Port congestion
-
Carrier operational issues
-
Customs or regulatory inspections
-
Force majeure events
7. Liability and Limitation
TutkuSaL acts as a freight forwarder and is not the carrier unless specified. Liability is limited to:

Applicable international conventions (Hague-Visby, CMR, Warsaw, Montreal, etc.)

Carrier or service provider liability
TutkuSaL is not liable for:

Indirect or consequential losses
-
Business interruption
-
Market or commercial losses
8. Insurance
Cargo insurance is not included unless agreed in writing. Clients are strongly advised to arrange:

Marine cargo insurance
-
Livestock or specialized risk coverage
TutkuSaL may assist in arranging insurance upon request.
9. Customs and Compliance
The Client is responsible for:

Legal compliance
-
Accurate documentation
-
Import and export permits
TutkuSaL acts as an agent and is not responsible for regulatory decisions or delays.
10. Payment Terms
Payment terms are specified in quotations or contracts. TutkuSaL reserves the right to:

Request advance payment
-
Suspend services for unpaid invoices
-
Apply late payment charges
All costs incurred due to non-payment are the Client’s responsibility.
11. Force Majeure
TutkuSaL shall not be liable for events beyond reasonable control, including:

Natural disasters
-
Political instability
-
War, strikes, or embargoes
-
Pandemic or public health restrictions
-
Government or regulatory actions
12. Confidentiality
All commercial and operational information shared with TutkuSaL will be treated confidentially and used only for service execution.
13. Claims and Disputes
Claims must be submitted in writing within:

7 days for visible damage
-
14 days for hidden damage
Failure to notify within these periods may result in rejection of claims.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of Turkey unless otherwise agreed in writing. Any disputes shall be resolved through:

Negotiation

Arbitration or competent courts in Turkey
15. Amendments
TutkuSaL reserves the right to update these Terms & Conditions. Updated versions will be published on our website.
